NTEU Offers Advice on Background Investigations:
To help clear up confusion felt by many employees summoned to a background investigation, NTEU has developed guidance that answers commonly-asked questions. http://www.nteu.org/Documents/BackgroundInvestigations.pdf
Employees are subject to background investigations when they are first hired or move into positions of greater sensitivity or risk level. Those in certain "sensitive" positions must undergo periodic reinvestigations every five years. The process for many employees includes a personal interview.
NTEU's guidance covers a range of common questions about the process, employee rights and how the union can help. Now that OPM investigators commonly exclude union representatives from the room during the employee interview, employees should consult their NTEU representative in advance. The union representative can offer advice on how to handle possible problem areas and guidance on what subject matters can and cannot be addressed in the interview. NTEU can also assist in filing a complaint should the employee believe that the investigator acted unprofessionally.
Q. How Do I Know If I Need Union Representation In A Meeting? A. Any time you are advised you are entitled to Union Representation, you NEED it. Don't sign away your right to union representation.
Investigatory Interviews (Article 3, Section 8) Prior to beginning an investigatory interview, Public Debt shall inform the employee of the specific nature of the matter to be discussed and whether it involves or potentially involves criminal or administrative misconduct.
A. Employees will be notified of their rights pursuant to 5 USC 7114(a)(2)(B) to be
represented by NTEU during an investigatory interview as described in Article 5,
Section 2A.2. This notification may be given orally or in writing prior to the
beginning of the interview. If during an interview an employee who is not initially
the subject of an investigation provides information that would potentially make
the employee the subject of an investigation, the employee will be advised orally
or in writing of their rights.

Know Your Rights: Employees who are called in as witnesses in an investigation are entitled to union representation when they request it. This is true at the beginning of the interview or at any stage during the interview when 'reasonable fear of receiving discipline as an outcome of the interview' rears its ugly head. Requesting union representation DOES NOT mean you have something to hide, it means you are SMART. Request union representation and do not meet until you get it.
